The Federal Energy Regulatory Commission (FERC) is revising its regulations to modify the market-based rate authority of current market-based rate sellers to establish consistency in types of events that trigger a change in status for market-based rate sellers and to ensure that all events are timely reported. FERC is proposing to eliminate the option to delay reporting changes of status until the market-base rate seller submits their updated market power analysis which under current regulations can be three years after the event has taken place. FERC believes that in today's electric industry, granting market-based rate sellers
