Approved with the following conditions. Prior to submitting this record keeping requirement for clearance in l983, FRA should evaluate the following items to ensure they are minimal burdens on the railroad industies while meeting statutory requirements. (1) Why the requirement to tag "each side of the car" (49 CFR 215.9(a)(3)) can not be relaxed to allow the railroad industry to tag only one side of the freight car, and (2) What are the costs associated with Federal and state inspectors inspecting and investigating railroad companies for compliance of this record keeping requirement. Since these governmental inspectors inspect railroad companies for compliance of numerous Federal safety regulations, only the costs of FRA's rail inspection program allocated to enforcing this record keeping requirement should be identified. In subsequent requests, FRA should also include not only applicable statutes but also applicable regulations with those portions related to any record keeping or reporting requirements underlined.

RAILROADS ARE REQUIRED TO ATTACH A CARD AND KEEP RECORD FOR 90 DAYS OF DEFECTIVE RAILROAD FREIGHT CARS THAT ARE MOVED BY TRAINS FOR REPAIRS. THESE RECORDS WILL DETERMINE IF DEFECTIVE RAILROAD FREIGHT CARS ARE BEING MOVED WHEN THEY COULD BE REPAIRED WITHOUT MOVEMENT (49 CFR 215).
