REGULATION IS NECESSARY AND IS NOT OTHERWISE AVAILABLE TO PBGC.
UNDER THE STATUTE, PBGC MAY GRANT VARIANCES OR EXEMPTIONS FROM
CERTAIN STATUTORY REQUIREMENTS THAT WOULD OTHERWISE BE IMPOSED WHEN
AN EMPLOYER CEASES WORK UNDER A MULTIEMPLOYE PLAN AS A RESULT OF A
SALE OF ASSETS. IN ORDER TO MAKE SUCH DETERMINATIONS, THE PBGC
NEEDS CERTAIN INFORMATION FROM THE PARTY WHO APPLIES FOR THE
EXEMPTION.

1320.8(b)(3).
