which the information collected on Form 5100.31 is used, it has not
identified the purpose, utility, and use of the regulatory labeling
requirments. BATF should submit a new justification that addresses
the purposes and uses of the label approval process. For example,
BATF should explain why the consistency of labels of firm having
establishments in several regions is a Federal concern and how the
label approval process contributes to BATF objectives. BATF shoul
explain how the file of labels assists in the identification of
adulteration, health hazards, and false advertising claims.
Examples should be provided of specific cases in which the labeling
approval process contributed to the detection and/or correction of
each type of problem. BATF also should provide information for a
recent period concerning the number of instances of each type of
violation detected, the degree of seriousness, and the outcome. If
at any time BATF woud like to discuss this clearance, the Departmen
should request a meeting with the OMB Desk Officer.

THE FEDERAL ALCOHOL ADMINISTRATION
ACT, P.L. 74-401 REGULATES THE LABELING OF ALCOHOLIC BEVERAGES AND
DESIGNATES TREASURY DEPARTMENT TO OVERSEE COMPLIANCE WITH
REGULATIONS. THIS FORM IS COMPLETED BY THE REGULATED INDUSTRY AND
SUBMITTED TO TREASURY AS AN APPLICATION TO LABE THEIR PRODUCTS.
TREASURY OVERSEES LABEL APPLICATIONS TO PREVENT CONSUMER DECEPTION
AND TO DETER FALSIFICATION OF UNFAIR ADVERTISING PRACTICES ON
ALCOHOLIC BEVERAGES.
