THE 3809 REGULATIONS PROVIDE
PROCEDURES TO ALLOW OPERATORS ON MINING CLAIMS TO EXERCISE THEIR
RIGHTS UNDER THE 1872 MINING LAW AND FOR THE BUREAU OF LAND
MANAGEMENT TO CARRY OUT ITS STATUTORY MANDATE TO PREVENT
UNNECESSARY OR UNDUE DEGRADATION OF THE PUBLIC LAND. THE
REGULATIONS REQUIRE THE OPERATOR TO FILE EITHER A PLAN OF
OPERATIONS OR A NOTICE, WITH RECLAMATION OUTLINED, TO SATISFY THE
STATUTE.
