We have approved
continued use of these recordkeeping requirements in light of the
schedule submitted by the agency for regulatory review. This
schedule, which calls for an NPRM by June 1989 and a fin by March
1990, must be included in the next Unified Agenda of Federal
Regulations for the agency. We first flagged this information
collection as a possible certification in July 1983 and approved
its use through February 1985 to give MSHA time to complete a
scheduled rulemaking on these regulations. In January 1985, OMB
further approve this information collection through December 1986,
on the under standing that MSHA intended to change the requirement
to a certification. On January 5, 1987, OMB again extended approval
throug July 1987 with the condition that MSHA resubmit it with a
full explanation of the status of the rulemaking a schedule for
completion. On July 2, 1987, OMB extended this information
collection yet again, through March 31, 1988, to give the agency
more time to submit a schedule for rulemaking. In this, the fifth
resubmission, MSHA has submitted a two-year schedule for
rulemaking. In order for us to extend approval, the agency must
adhere to its schedule.
