Abstract: FDA USES THE ADMINISTRATIVE DETENTION AND BANNED DEVICE REGULATIONS TO PROTECT THE PUBLIC HEALTH. ADMINISTRATIVE DETENTION IS USED IF A DEVIC IS ADULTERATED AND/OR MISBRANDED AND IMMEDIATE ACTION IS NECESSARY TO PREVENT THE DEVICE FROM REACHING THE CONSUMER. FDA WILL BAN A DEVICE ONCE A DETERMINATION HAS BEEN MADE THAT IT PRESENTS A SUBSTANTIAL DECEPTION OR AN UNREASONABLE RISK OF ILLNESS OR INJURY.
