days with the following conditions. (1) The HUD form 9746,
"Specification of Repairs," is not approved for use. HUD has failed
to indicate the specific problems created by allowing the
submission of "work orders," which is HUD's current practice. These
work orders describe the rehabilitation work to be performed and
are a "usual and customary" information requirement (i.e., the
standard private-sector requirement) in rehabilitation work and
property appraisals. Without an enumeration and description of
specific problems associated with the acceptance of work orders,
the benefits of conforming to standard industry practice override
HUD's desire to impose a uniform reporting requirement. HUD may
require work orders to be submitted under this OMB control number.
(2) In addition, HUD must provide a stronger rationale for
regulating draw requests (HUD form 9746-A). This rationale should
identify the contractual agreements entered into by HUD with the
mortgagee and mortgagor for the issuance of mortgage insurance
under the 203(k) program, and should discuss the feasibility of
making the insurance contract contingent on the successful
completion of work identified in the work contract, which should
obviate HUD's need to regulate draw requests.
