We have approved
this survey for three years. The survey shall use the letter format
recommended by Michelle McLaurin of HUD for collecting income
information from tenants. We agree that this format, in conjunction
with the Privacy Act statement, should protect the privacy of
respondents. However, the Department shall delete from the letter
the line at the bottom of the page that reads "for use by
owner/manager...." Coding by the owner/manager shall be done on a
separate sheet.

THE HCD AMENDMENTS ACT OF 1978, AS
AMENDED BY THE HCD OF 1987 AND THE MCKINNEY AMENDMENTS OF 1988,
REQUIRES THAT HUD PRESERVE THE NUMBER OF UNITS WHICH ARE OCCUPIED
BY LOW OR MODERATE INCOME PERSONS AT THE TIME OF ASSIGNMENT OR
FORECLOSURE, WHICHEVER IS GREATER. HUD MUST, THEREFORE, INQUIRE AS
TO THE INCOME LEVEL OF UNASSISTED TENANTS FOR WHOM INFORMATION IS
NOT AVAILABLE.
