Pursuant to 5 CFR 1320.13, we extend OMB approval for the existing information collection requirements at 29 CFR 1904.8, but we do not approve proposed changes to these requirements. After OSHA reviews all comments received in response to the NPRM, the agency may seek PRA approval for these new information collection requirements. In keepin with section 3504(h) of the PRA, OSHA shall respond to the following comments in its final rule: (1) How will OSHA (and States in State-pla States) be able to respond quickly and effectively to the increased number of injury reports that would result from OSHA's proposal to decrease this reporting threshold from five to three? OSHA should develop a firm estimate, including data submitted by commenters, of th additional reports to which it would have to respond as a result of th proposal. (2) OSHA shall demonstrate the practical utility of its proposed requirement for employers to record all work-related deaths which occur among employees up to six months after an on-the-job injur OSHA shall answer the following related questions: a) What criteria will be used to determine whether a post-injury death is truly job- related? b) Is it feasible or cost-effective for employers to track injured employees who leave the employ of that firm? and c) Will these reports be accurate enough to justify the additional burden of collection?
