through 1/98 under the condition that HCFA thoroughly addresses the
previous OMB clearance remarks dated February 6, 1996 and January
30, 1995. In particular, HCFA must include an evaluation of
hospital compliance with these requirements and the extent to which
implementation experience is consistent with public comments in the
interim final rule. In addition, HCFA must amend its burden
estimates to reflect ongoing experience in the field. Finally, OMB
notes that on pg. 3 of its Supporting Statement, HCFA asserts that
"copies of the IFC and pertinent manual instructions released to
date are attached to this extension request." OMB's clearance
package does not contain HCFA manual instructions, and the
Department's Federal Register solicitations did not refer to manual
instruc- tions. Accordingly, OMB clarifies that this particular
clearance action applies only to the regulatory provisions, not
HCFA implementing manuals.

BPD-393 contains information
collection requirements for hospitals that would seek to prevent
them from inappropriately transferring individuals with emergency
medical conditions, as mandated by Congress. HCFA will use this
information to help assure compliance with this mandate. This
information is not contained elsewhere in regulations.
