CFR 1320.11, the proposed revision of this collection of
information is not approved. Prior to submission of the final rule,
EPA should present the respondent hour burden that will be borne by
contractors as labor hours rather than as an operations and
maintenance cost. Additionally, EPA should clarify the relationship
between the emissions monitoring hour and cost estimates provided
in the supporting statement and the total burden estimates listed
under this control number on the submission form. Also, EPA should
include the annualized capital cost of purchasing monitoring
equipment, described in the 1993 RIA, in the ICR associated with
the final rule, and in future ICRs under this control number. EPA
should calculate all cost estimates on the submission form and in
the supporting statement in current dollars. Finally, pursuant to 5
CFR 1320.8(b)(iii) and (vi), EPA should revise forms 7610-12 and
7610-14 to include: (a) an estimate of the average burden of the
collection, together with a request that the public direct to the
agency comments concerning the accuracy of the burden estimate and
any suggestions for reducing the burden; and (b) notification that
an agency may not conduct or sponsor, and a person is not required
to respond to, a collection of information unless it displays a
currently valid OMB control number.

The information to be collected under
this ICR is necessary to implement the Acid Rain Program.
Respondents are utilities subject to acid rain requirements under
title IV of the Clean Air Act. Respondents must submit monitoring
plans, certify monitoring systems, conduct and quality-assure
monitoring, submit quarterly reports and other occasional
notifications, and maintain records. The EPA will use this
information to ensure compliance with emission limitations and
tract us of allowances under the market-based Acid Rain trading
program.
On behalf of this Federal agency, I certify that

1320.8(b)(3).
