OMB recognizes that this is a very important rulemaking and also controversial. Understanding that this is a NPRM, OMB encourages the FCC to weigh the comments of all entities carefully, especially when creating the complaint process. OMB believes that the first step should be consumer contact with the vendor -- and that the consumer must be provided with clear and accurate contact information and that the vendor must establish and support a single point of contact. OMB encourages the FCC to adopt rules that promote reasonable and, to the degree possible, broad access to information regarding vendor equipment and services targetted to those with disabilities. Such rules may include use of web access and devices that are responsive to the unique needs of the user community. OMB also encourages the FCC to adopt requirements in the complaint process that ensure that it is not abused and not unduly burdensome to vendors or consumers. Issues of Standing, time limits, response times, and protection of proprietary information raised by SBC and CEMA are valid and need to be addressed in this rulemaking. A key need of consumers is access to information related to use and repair of access devices and services. The FCC should ensure that all third party notifications and information collections are accounted for in the final rule, including such provisions as the requirement to share TRS STS call volume information between vendors and states. OMB encourages industry and the FCC to work with users and others to reach agreement on labeling, use of the web, and other devices that will inform the public as to steps to improve their access to telecommunications services and equipment.

Respondents will be consumers, telecommunications equipment providers, and telecommunications service providers. The burdens proposed in the NPRM are limited to those necessary to ensure that telecommunications equipment and services are available to all Americans, including those individuals with disabilities. The proceeding's ultimate goal is the implementation of section 255 of the Telecommunications Act of 1996.
