Before resubmission of this ICR, the Agency should update its
estimate of burden, taking into consideration both experience with
the recently promulgated rule and also the forthcoming contractor's
report on the number of roads and vacant lots in Maricopa County
that are likely to be subject to these reporting and recordkeeping
requirements.

EPA is under court order to propose
FIP measures to reduce PM-10 in the Phoenix, Arizona, nonattainment
area by March 20, 1998, and promulgate measures by July 18, 1998.
EPA is proposing a rule which controls dust from vacant lots,
unpaved parking lots, and unpaved roads. The requirements of the
rule include controls such as paving, stabilizing, vegetating, and
applying gravel to these sources and also includes recordkeeping
and reporting requirements to help ensure compliance with the
rule.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
