This ICR is not approved. It is not clear that the record keeping and reporting requirements associated with the proposed revision to the Sewage Sludge Use and Disposal Regulations have practical utility, as required by 1320.9(a), and reduce to the extent practicable and appropriate the burden on persons who shall provide information to or for the agency, as required by 1320.9(c). Specifically, it is not clear that establishing a land application standard for dioxins at 300 ppt, and requiring periodic monitoring to ensure that this standard is achieved (particularly the proposed requirement for annual monitoring if the previous sample contained dioxins in excess of 30 ppt) has practical utility or serves any significant public health purpose, given that the maximum risk associated with the proposed 300 ppt standard is less than the background environmental risk from dioxins. EPA should reassess whether the proposed standard and associated record keeping and reporting requirements are needed as it develops the final rule.

EPA is proposing to amend 40 CFR part 503 Standards for the Use or Disposal of Sewage Sludge. These proposed Round 2 Amendments establish in numerical limit of 300 ppt TEQ dioxins in land applied sewage sludge. These proposed amendments also establish two monitoring schedules for preparers sludge for land application. Small entities are excluded from provisions of these proposed amendments.
