The Screener
Questionnaire for the Aquatic Animal Production Industry is
approved. However, the Detailed Questionnaire that was also
submitted as part of this ICR is not approved. Based on extensive
comments from the public, OMB is satisfied that the Screener
Questionnaire complies with the requirements of the Paperwork
Reduction Act, and 5 CFR Part 1320, particularly the requirement to
ensure that information collections have practical utility
(1320.9(a)) and reduce to the extent practical and appropriate the
burden on respondents (1320.9(c)). However, OMB is concerned that
the Detailed Questionnaire, which EPA estimates will take an
average of 23-31 hours per respondent to complete, may not satisfy
this latter requirement, particularly with respect to the small
entities that constitute the majority of the proposed respondents._
OMB is approving the Screener Questionnaire at this time in order
to allow the Agency to move forward with this information
collection, which is a necessary step in the Court-supervised
development of effluent guidelines for this industry. EPA may
resubmit the Detailed Questionnaire, under a separate ICR number,
to OMB for further consideration. OMB will continue to explore with
EPA ways of reducing the burden of this questionnaire, particularly
on small entities, while still satisfying the information
collection needs of the rule development effort. Because the public
has already been afforded two opportunities to comment on the
Detailed Questionnaire, EPA does not need to publish an additional
Federal Register Notice or solicit additional public comment.

The 2000 Aquatic Animal Production
Industry Detailed Survey is intended to collect technical and
economic information required by EPA to develop effluent
limitations guidelines and standards for the Aquatic Animal
Production Industry Point Source Category at 40 CFR 451. The 2000
Aquatic Animal Productionj Industry Screener Survey is intended to
collect characterization informa- tion on facilities in the
industry. The sampling data follow-up is intended to be used to
generate limitations guidelines and standards as well as economic
impacts of technology use at aquatic animal production
facilities.

1320.8(b)(3).
