Collection Background


The Form SSA-8202-OCR-SM is used exclusively for low probably of error profile (LEP) redeterminations. It is mailed on a 6-year cycle to recipients who complete it without a personal contact interview with an Agency employee. It contains 16 questions and has been found to be very cost effective. The information is used to determine whether SSI recipients' have met and continue to meet all statutory and regulatory requirements for SSI eligibility and whether they have been and are still receiving the correct payment amount.


Reason for Change


SSA is seeking three changes to the SSA-8202-OCR-SM:


1. 20 CFR, Section 416.210ff requires that applicants for SSI benefits must apply for all other benefits for which they may be eligible. Failure to apply for other benefits would result in either suspension of current benefits or a non-medical denial of a current application.


The Commissioner of Social Security has identified a workload that needs immediate attention. This workload, Special Disability Workload, identifies SSI individuals that are eligible for Social Security disability benefits because they earned sufficient work credits to qualify for benefits. The addition of a four part question soliciting information about the possibility of entitlement to Social Security retirement, survivors or disability benefits will be added as question 13. Question 13, the language preference question will be renumbered to question 14.


The new question 13 is as follows:


13a. Are you age 62 or older?

13b. If you are age 50 or older, are you a widow (er)?

13c. If you are age 50 or older and divorced, is your divorced spouse deceased?

13d. If you were disabled before age 22, do you have a parent who is age 62 or older or disabled, or deceased?






SSA Redetermination Forms 8202-BK and 8203-BK currently list these questions.


2. The fugitive felon wording on question 14 is obsolete and is being changed to OMB approved language (based on DOJ guidance). The approved language will appear on the revised SSA-8001. The new, revised language will be questions 15 and 16 on the SSA-8202-OCR-SM:


The new question 15 is:


Do you have any unsatisfied felony warrants for your arrest (Y/N)

In which state or country was the warrant issued?

Was the warrant satisfied (Y/N)

Date warrant satisfied


The new question 16 is:


Do you have any unsatisfied Federal or State warrants for violating the conditions of probation or parole? (Y/N)

In which state or country was the warrant issued?

Was the warrant satisfied? (Y/N)

Date warrant satisfied


The fugitive felon questions on the SSA-8202-BK and SSA-8203-BK are also obsolete and SSA will be seeking changes to these forms to include the updated, approved language.


3. SSA is also seeking a minor format change to question 3 of the SSA-8202-OCR-SM to make it a more efficient collection vehicle. Currently on the form question 3 asks "Since month/year, has anyone moved into or out of the place where you live? (also report births and deaths) YES NO." In the instructions to complete the 8202 it states if YES please explain. However, SSA does not provide an up-front space for a "yes" answer, which forces the respondent to use the remarks section.


WBDOC employees who process the form report that recipients/payees do not use the remarks section. When this happens, the WBDOC employees must call the individual/payee to obtain the information that should have been reported. SSA believes that such contacts will be greatly reduced if the form provides up-front space for an explanation of a "yes" answer immediately following question 3. As a result SSA is proposing to add space within question 3 for the respondents to provide the information.


Attached is a mock-up of the proposed changes.
