Revenue Procedure 2006-40
CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION
This notice provides the time and manner for a taxpayer to apply for an allocation of the national megawatt capacity limitation for purposes of the credit for the production of electricity from advanced nuclear power facilities under § 45J of the Internal Revenue Code (hereinafter, this application is referred to as an “application for allocation”). A taxpayer receiving an allocation of the national megawatt capacity limitation may take a credit for electricity produced at its advanced nuclear power facility and sold to an unrelated third party.
USE OF DATA
The information will be used by the Internal Revenue Service to allocate the limited credit among applicants.
USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN
IRS Publications, Regulations, Notices and Letters are to be electronically enabled on an as practicable basis in accordance with the IRS Reform and restructuring Act of 1998.

This notice was published in the Internal Revenue Bulletin (2006-18 I.R.B. 855), on May 1, 2006. In response to the Federal Register notice (71 FR 26811), dated May 8, 2006, we received no comments during the comment period regarding Notice 2006-40.

Generally, tax returns and tax return information are confidential as required by 26 USC 6103.

ESTIMATED BURDEN OF INFORMATION COLLECTION
The collections of information are in section 3 of this notice. Taxpayers are required to obtain an allocation of the national megawatt capacity limitation in order to claim the credit for production of electricity from advanced nuclear power facilities. The information will be used to allocate that capacity among applicants. The estimated total annual burden is 600 hours. The estimated annual burden per respondent varies from 10 to 60 hours, depending on individual circumstances, with an estimated average of 40 hours. The estimated number of respondents is 15.
Estimates of the annualized cost to respondents for the hour burdens shown are not available at this time.
ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS
As suggested by OMB, our Federal Register notice dated May 8, 2006, requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.

REASON FOR CHANGE IN BURDEN
There is no change in the paperwork burden previously approved by OMB. However, there was a change to the original Title and Notice number.

REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE
We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the notice sunsets as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.
