Report of Multiple Sale or Other Disposition of Pistols and Revolvers

ATF F 3310.4


  1. Justification


    1. Title 18, United States Code 923 (g) (3) provides that “Each licensee shall prepare a report of multiple sales of other dispositions whenever the licensee sells or otherwise disposes of, at one time or during any five consecutive business days, two or more pistols, or revolvers, or any combination of pistols or revolvers totaling two or more, to an unlicensed person.” The report shall be prepared on ATF F 3310.4, Report of Multiple Sale or Other Disposition of Pistols and Revolvers. It is pertinent that the Multiple Sale or Other Disposition Report was originally a regulatory requirement that was incorporated into the Gun Control Act when it was amended in 1986.


    1. These reports of multiple sales or other dispositions are used by ATF as a means to discern patterns in the purchase of firearms that may end up in the interstate trafficking of illegal firearms. The information is used to determine if the buyer (transferee) is involved in an unlawful activity, or is a person prohibited by law from obtaining firearms. The report shall be prepared not later than the close of business on the day that the multiple sale or other disposition occurs.


    1. This information collection is not available on the ATF website because (1) the form is a multiple copy form (2) the form is formatted as a self-mailer and (3) the internet does not have the capability to accommodate these features. This particular information collection would not be able to comply with the GPEA requirement to make the collection fully electronic.


    1. The Federal Information Locator System (FILS) program has been terminated for agency use. However, an agency subject classification system is used to identify duplication. Similar information is not available elsewhere for this information collection requirement.


    1. The collection of information does not have any impact on small business or other small entities.

    1. The consequence of not conducting this information collection would pose a threat to public safety. The information collection documents certain sales or other dispositions of handguns for law enforcement purposes.


    1. There are no special circumstances for this information collection and it is in conformance with the guidelines of 5 CFR 1320.6


    1. The ATF National Tracing Center and ATF Chief Counsel were consulted for this information collection. The information requested is mandatory and required by statute (18 U.S.C. 923 (g) (3)). A 60 day and 30 day notice was published in the Federal Register to solicit comments from the general public. No comments were received.


    1. No payment or gift is associated with this collection.


    1. Respondent’s confidentiality is protected by 26 U.S.C. 6103, 5 U.S.C. Section 55(a) and 552.


    1. No questions of a sensitive nature are asked.


    1. The estimated number of respondents is 10,000. The frequency of responses is 4 per respondent per year. The total number of responses is 40,000. The annual burden is 4 x 10,000 x 12 minutes to complete the form = 8,000 hours. The estimated average time per response is based on information provided by ATF personnel working in the field who have queried licensees who have executed the form.


    1. It is estimated that three fourths fax their response. Therefore, the cost burden for #14. 83-I will be shown as 0.
