The Federal Plan Requirements For
Municipal Solid Waste Landfills That Commenced Construction Prior
to May 30, 19991 and Have Not Been Modified or Reconstructed Since
May 30, 1991, 40 CFR Part 62, Subpart GGG, promulgated on November
8, 1999, apply to any existing municipal solid waste landfill
located in a State that is not covered by an approved and effective
state plan. The standard also applies to existing municipal solid
waste landfills located on Indian land. Additionally, the standard
applies to existing landfills that handled everyday household waste
and were in operation from November 8, 1987 to May 30, 1991, or had
capacity available for future waste disposal. Municipal solid waste
landfills constructed on or after May 30, 1991 or municipal solid
waste landfills which had changes in design capacities on or after
May 30, 1991, are subject to EPAs new source performance standards
and not this standard.
