SUPPORTING STATEMENT FOR BLOOD DONOR LOCATOR SERVICE (BDLS)

A. Justification


  1. 42 USC 1320b-11 of the United States Code and Section 1141(a) of the Social Security Act require the Commissioner of the Social Security Administration (SSA) to establish and direct a Blood Donor Locator Service (BDLS). These regulations also require participating State agencies to provide the BDLS with specific information on blood donors who have tested positive for Human Immunodeficiency Virus (HIV). SSA has codified these laws under 20 CFR 401.200 of the Code of Federal Regulations.


  1. The purpose of the BDLS is to provide an additional means by which States and authorized blood donation facilities can locate and notify blood donors that they are or may be infected with human immunodeficiency virus (HIV), a virus which causes acquired immune deficiency syndrome (AIDS). Blood donors should be in possession of this information since they may need medical care and treatment. States and authorized blood donation facilities within States may request the SSA BDLS to furnish the last known address for suspected HIV-infected blood donors through a written request from the State agency that has the duty or authority under State law relating to public health, and which has entered into an agreement with SSA for this purpose.


  1. Because the BDLS is a service mandated by government regulation, not an actual information collection form, it is not subject to the agency’s Government Paperwork Elimination Act (GPEA) plan. Therefore, no electronic versions of the BDLS are planned.


  1. The nature of the information being collected and the manner in which it is collected preclude duplication. There is no other collection instrument used by SSA that collects data similar to that collected here.


  1. This collection does not have a significant impact on a substantial number of small businesses or other small entities.


  1. If this information were not collected, then SSA would not be complying with the law. Also, as this information is only collected as needed, it cannot be collected less frequently. There are no technical or legal obstacles that prevent burden reduction.


  1. There are no special circumstances that would cause this information collection to be conducted in a manner that is not consistent with 5 CFR 1320.5.


  1. The 60-day advance Federal Register Notice was published on September 11, 2006 at 71 FR 53485, and SSA has received no public comments. The second Notice was published on January 17, 2007, at 72 FR 2081. There have been no outside consultations with members of the public.


  1. SSA provides no payment or gifts to the respondents.


  1. The information requested is protected and held confidential in accordance with 42 U.S.C. 1306, 20 CFR 401 and 402, 5 U.S.C. 552 (Freedom of Information Act), 5 U.S.C. 552a (Privacy Act of 1974) and OMB Circular No. A-130.


  1. The information required by this regulation is sensitive. The law and regulations require strict confidentiality during all phases of processing and the immediate destruction of all records related to the BDLS requests after use by both SSA and requesters.


  1. The frequency of requests per State agency is estimated at an average of 5 per year, with an estimated 10 participating State agencies; therefore, the total number of requests is 50 per year. At an estimated 15 minutes to prepare each request, the annual burden is estimated at approximately 13 hours. The total burden is reflected as burden hours, and no separate cost burden has been calculated.


  1. There is no known cost burden to the respondents.


  1. The annual cost to the Federal Government is approximately $2,000.00. This estimate is a projection of the costs for collecting and processing the information.


  1. There are no changes in the public reporting burden.


  1. The results of the information collection will not be published.


  1. SSA is not requesting an exception to publishing the OMB expiration date.


  1. SSA is not requesting an exception to the certification requirements at 5 CFR 1320.9 and related provisions at 5 CFR 1320.8(b)(3).


B. Collections of Information Employing Statistical Methods
