Composite Interference Contour
Justification:
Under section 1.929(c)(1) of our rules, any increase in the composite interference contour (CIC)1 of a site-based licensee in the Paging and Radiotelephone Service, Rural Radiotelephone Service, or 800 MHz Specialized Mobile Radio Service is a major modification of a liclicense that requires prior Commission approval.
However, on February 22, 2005, April 28, 2003, the Commission released a Notice of Proposed Rule Making Report and Order in WT Docket No. 03-103 (7068 FR 1929344003), proposing to in which it amended § 1.929(c)(1) of our rules to specify that expansion of a composite interference contour (CIC) of a site-based licensee in the Paging and Radiotelephone Service—as well as the Rural Radiotelephone Service and 800 MHz Specialized Mobile Radio Service—over water on a secondary, non‑interference basis should be classified as a minor (rather than major) modification of a license. If adopted, sSuch reclassification has would eliminated the filing requirements associated with these license modifications, but requires site-based licensees to provide the geographic area licensee (on the same frequency) with the technical and engineering information necessary to evaluate the site-based licensee’s operations over water.
Statutory authority for this collection of information is contained in 47 C.F.R. § 1.929(c)(1), as amended.
The purpose for this collection is to enable the geographic licensee to have technical and engineering information regarding a site-based licensee’s operations over water in order to guard against unacceptable interference to its own operation(s).
Prior to finalizing rulemakings, the Wireless Telecommunications Bureau conducts an analysis to ensure that improved information technology cannot be used to reduce the burden on the public. This analysis considers the possibility of obtaining and/or computer-generating the required data from existing databases in the Commission or other federal agencies.
No similar information is available.
In conformance with the Paperwork Reduction Act of 1995, the Commission is making an effort to minimize the burden on all respondents, regardless of size. The Commission has limited the proposed information requirements to those absolutely necessary for geographic licensees to have technical and engineering information regarding site-based licensees’ operations over water in order to guard against unacceptable interference to their own operation(s).
If the information were not collected, a geographic licensee would not have technical and engineering information regarding a site-based licensee’s operations over water in order to guard against unacceptable interference to its own operation(s).
The proposed data collection is consistent with 5 C.F.R. § 1320.66.
This is a new information collection. Pursuant to the public notice and procedure requirements contained in the Administrative Procedure Act, 5 U.S.C. § 553, weA notice was have published notice of this information collection which appeared in XX7968 on November 29, 2006 (71 FR XXXXX69119)48388 (November 29, 2006),, in compliance with 5 C.F.R. Section 1320.8.of the Federal Register. We have received no comments on the notice. A copy of the notice is included in this submission to OMB.is matter.
Respondents will not receive any payments.
There is no need for confidentiality.
This collection does not address any private matters of a sensitive nature.
We’ve determined that the number of licensees who are required to provide the geographic area licensee (on the same frequency) with the technical and engineering information necessary to evaluate the site-based licensee’s operations over water will remain the same. Therefore, estimate that 50 respondents will be subject to this requirement annually. We estimate that it will take 1 engineer approximately 2 hours to meet this requirement. We assume that this requirement can be met by use of in-house personnel.
50 (respondents) x 2 hrs (engineer) = 100 hrs.
Total Hour Burden: 100 hours.
13. Assuming that respondents will use in-house engineering personnel, we estimate respondents’ cost to be $32.00 per hour.
$32.00 (engineer) x 100 hrs = $3,200.00
Total Cost Burden: $3,200.00

There is no change in burden.Although the designation of site-based licensees in the Paging and Radiotelephone Service—as well as the Rural Radiotelephone Service and 800 MHz Specialized Mobile Radio Service—over water on a secondary, non‑interference basis should be classified as a minor (rather than major) modification of a license, site-based licensees are still required to provide the geographic area licensees (on the same frequency) with the technical and engineering information necessary to evaluate the site-based licensee’s operations over water. This is a revision to the information collection. Therefore, wThis is a new information collection which will result in a program increase of 100 burden hours.e request this collection be approved for three years.

There areis an no exceptions to Item 19. The Commission published the 60 day notice on “delegated” letterhead when it was published in the Federal Register. The Commission discovered that a rulemaking revised this collection; therefore, it is ineligible for delegated approval. which corrects the number of respondents in item 13(a) of the OMB 83-I form..
No statistical methods are employed.
1 A CIC connects the outermost points of the intersecting interference contours for the base stations in a radio system. However, an incumbent's valid CIC does not include areas surrounded by the composite interior contour that are not part of the interference contours of the incumbent's individual sites.
