Federal Energy Regulatory Commission (FERC) issued a NOPR RM6-7-000 proposing to amend its Part 157, Subpart F, blankey certification regulations to expand the scope and sale of activities that may be undertaken in accordance with blanket authority. FERC proposes to expand the types of natural gas projects permitted under blanket authority and to increase the cost limits that apply to blanket projects. This Final Rule expands the scope of activities that can be undertaken pursuant to blanket authority by (1) increasing the project cost limit to $9,600,000 for an automatic authorization project and $27,400,000 for a prior notice project and (2) expanding the types of facilities that may be acquired, constructed, modified, replaced, abandoned, and operated under blanket certificate authority to include mainline facilities, certain LNG and synthetic gas facilities, and certain storage facilities. In addition, the Commission clarifies that a natural gas company is not necessarily engaged in an unduly discriminatory practice if it charges different customers different rates for the same service based on the date that customers commit to service.
