The revised
information collection associated with the proposed rule (RIN
2132AA81) is not approved at this time. However, the existing
information collection is approved for 18 months to allow time for
FTA to finalize the NPRM. FTA shall examine public comment in
response to the NPRM and will describe in the preamble of the final
rule how the agency has maximized the practical utility of the
collection and minimized the burden.

Under 49 U.S.C. Section 5309, FTA is
required to publish regulations on how proposed major fixed
guideway transit investments ("New Starts") will be evaluated
against criteria established by statue. This Rule codifies existing
practice. SAFETEA-LU, in addition to outlining the New Starts
program, established a new "Small Starts" program.

FTA has been collecting data
for the purpose of evaluating candidate New Starts projects, but
SAFETEA-LU has created a streamlined evaluation and project
development process for Small Starts. Since there has been no prior
regulatory requirement to collect this data, the entire burden
increase is therefore attributable to these new requirements. The
burden increased by 5,840 hours as a result of this new requirement
by the SAFETEA-LU regulation.
