Explanation

The overall burden for Section 1 has decreased by 170,933 hours, from 618,591 to 447,658 hours, compared with the last OMB clearance estimate. The primary reasons for the burden changes are indicated below:

Adjustment


The burden for technical application information for Early Site Permits, Standard Design Certifications, and Combined Licenses will be captured under 10 CFR 52 (3150-0151) instead of under 10 CFR 50, which results in a burden decrease of 173,667 hours. This burden reduction is considered an Adjustment, because, while the change will result from rulemaking, it is a shift of burden from Part 50 to Part 52 and an elimination of burden due to duplication in Part 52.

It is estimated that there will be a reduction in the number of license amendments requested during the clearance period, resulting in a burden decrease of 15,500 hours. This is considered a burden Adjustment, because this change was not as a result of a rulemaking or policy change.

NRC estimates that there will be an increase in burden of 18,234 hours for the general information submitted under 10 CFR 50.33 for combined license applications because of an expected increase in the number of Combined Operating License (COL) applications from 1 to 6.3 annually (19 COLs expected during the 3 year approval period) and because of a revised estimate of the burden per response. This change is considered an Adjustment to burden because it resulted from a change in the number of applicants not due to rulemaking, and a revision of estimates.

Explanation

The overall burden was reduced by 149,207 hours from 526,230 to 377,023 hours primarily because of the following:

Adjustments:





















1) more precise estimates have been made. These are considered Adjustments, because they result from industry feedback and an increase in the number of special reports. They also were not related to rulemaking and policy changes, and are a net of the following:


Industry feedback on the burden to gather data and prepare the Annual Non-Radiological Report, resulting in a decrease from 1,400 hrs to 60 hrs per licensee for operating reactors and a decrease from 140 to 60 hours for shutdown reactors. The burden reduction for 78 licensees is 88,947 ((65 x 1,340 = 87,100) + (13 x 80 = 1,040) + 807 misc. hours);


Industry feedback on the burden per response to prepare monthly operating and shutdown reports resulting in a decrease from 50 hours to 5 hours monthly, with a burden reduction of 56,160 hours (45 hrs x 104 plants x 12 months = 56,160 hrs);


Increase in number of special reports received for all licensees from 0 to 50 based on the actual number of reports received annually during the current clearance cycle. This results in an increase of 15,000 hours (50 X 300 = 15,000). Although 50 reports were received for all power reactors, none were received for the operating and research reactors which had an estimated burden of 11,440 hours, therefore the burden only increased by 3,560 hours.

Program Changes













2) the NRC has amended the reactor licenses and eliminated reports. These are considered Program Changes, because NRC changed policy and regulations to achieve these changes. The changes are as follows:


Startup Reports for research and test reactors that have Improved Standard Technical Specifications (ISTS), have been removed and only require 1 report per year (not per plant) to be submitted, resulting in a decrease from 36 to 1 report and decrease in burden of 3,500 hours (35 x 100 = 3,500);


Adoption of model license amendment eliminating reporting requirement for Occupational Radiation Exposure Reports for all nuclear power licensees, reducing the number of reports from 104 to 0 reports, resulting in a 4,160 hour burden reduction (104 x 40 = 4,160).

Adjustment

The burden has decreased by 3,550 hours because of a reduction in the number of operating non-power reactor sites and a reduction in the number of permanently shutdown power and non-power reactor sites (i.e., decommissioned). This change is considered an Adjustment because the reduction occurred without involving rulemaking or policy changes.

No hydrogen control analyses were submitted during the previous clearance period. However, the burden for this section is expected to increase by 239 hours (135 hours/reporting and 104 hours/recordkeeping) because the NRC anticipates receipt of several combined license applications during this clearance cycle. This is considered an Adjustment, because the change is a result of an estimate revision and not a policy or rulemaking change.

Adjustment


The burden for a modified EM submittal has been re-estimated from 1,500 to 1,750 hours, based on staff experience, and the total burden for 0.6 submittals has increased 150 hours (from 900 to 1,050 hours). In addition, the total burden for preparation and submittal of an average of 1.6 schedules increased by 12 hours (from 13 to 25 hours). Therefore, the total annual burden has decreased by 387 hours (from 6,042 to 5,655 hours). This change is considered an Adjustment, because the re-estimation did not result from a rulemaking or policy change.

Adjustment


The burden decreased for the emergency planning requirements in 10 CFR 50.47, 10 CFR 50.54, and Appendix E to 10 CFR 50, by 567,601 hours, from 843,339 hours to 275,738 hours. The decrease in burden for emergency planning requirements resulted from analysis by NRC staff with prior industry experience determining that the impact of burden to industry was substantially over estimated. This is considered an Adjustment because staff re-estimated the burden and revised it without a rulemaking or agency policy change.

Program Change


The estimated burden has decreased by 4,388 hours, from 64,804 to 60,416 hours to reflect the number of plants which are expected to transition to NFPA 805 and the remainder responding to the issuance of NRC GL 2006-03. These changes are expected to make reporting and recordkeeping slightly easier for this section, and are considered Program Changes because of implementation of the NFPA 805 code and policy stated in NRC GL 2006-03.

Explanation


There was a decrease in burden of 24,471 hours, from 213,120 to 188,649 hours, because of the removal of Commission Order burden that was erroneously included in the previous submittal. In addition, requests to 2 specific plants for information are exempt from Paperwork Reduction Act requirements and should not have been included in the previous clearance renewal. Also, the number of responses to bulletins/generic letters is now assumed to be 3 per year versus 2 per year in the previous submittal. Overall, the number of responses has decreased by 151, from 562 to 411.

Adjustment


Out of the total decrease of 24,471 hours, 8,159 hours are considered to be Adjustments, because the decrease is related to the drop in the number of responses.

Program Change


The remaining 16,312 hours are considered Program Changes which are related to the exclusion of Commission Orders for this collection.

During the previous reporting period, there were no active construction permits. The burden increase of 984 hours reflects reports expected to be filed by 10 CFR 52 applicants associated with design and construction of new nuclear power plants. This burden increase is considered an Adjustment, because the increase is based on a re-estimate of reporting based on existing regulations.

The burden increase is considered an Adjustment, because it reflects an expected increase in 10 CFR 52 applications associated with construction of new nuclear power plants and does result from a change in existing regulations.

It is considered a Program Change, because it results primarily from the issuance of a rule to incorporate by reference the 2001 Edition and 2002 and 2003 Addenda of Division 1 of Section III and XI of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code and the 2001 Edition and 2002 and 2003 Addenda of the ASME Operations and Maintenance Code.

Adjustment

The burden for this section has decreased by 77,000, from 332,500 to 255,500 hours, because of a revised estimate of the number of changes for non-power reactors (test and research reactors) from 95 to 30, resulting in a burden decrease, and from a reduction in the number of licenses affected from 175 to 168. This is considered a burden Adjustment, as the revised estimates did not result from changes in regulations or policy.

FRACTURE TOUGHNESS TESTS, SURVEILLANCE AND REPORTS

Program Change

The estimated annual burden under Appendix G has increased by 550 hours from 2,050 to 2,600 hours because of an increase in the number of responses from 1 to 4 for Section IV.A.1. However, the burden per report decreased by 100 hours from 250 to 150 hours because of generic evaluation standards used to complete the reports. The projection represents the NRC’s staff estimates for the upcoming clearance period based on the reports received during the current clearance cycle. Burden for Appendix H decreased by 1,680 hours from 3,480 to 1,800 hours because of a reduction in the number of surveillance capsules being tested due to the implementation of an integrated surveillance program for boiling water reactors. The number of licensees responding under Section IV.A-C decreased from 20 to 10 and the annualized number of responses decreased from 26 to 15.


The overall estimated annual burden for this section has decreased by 1,130 hours from 5,530 to 4,400 hours because the industry has developed generic evaluation standards (contained in topical reports), approved by the NRC, that licensees can cite, which results in simplified evaluations. This is considered an Program Change, because, although the revision was not a result of NRC change in policy or rulemaking, the industry’s generic evaluation standards were revised to allow for greater efficiency in submitting this section’s information and NRC encouraged using the standards.

All licensees for nuclear power plants have submitted design and installation plans to NRC as required by 10 CFR 50.62. Licensees have also submitted schedules for implementing the requirements of 10 CFR 50.62. NRC has completed its review of the proposed schedules and the design and installation plans and has completed inspections of the installed systems. Therefore, the information collection requirement for the ATWS issue is complete.

This is considered a burden Adjustment because the reduction in burden did not result from a change in agency policy or rulemaking.

MAINTENANCE AT NUCLEAR POWER PLANTS

Explanation


The overall burden has increased by 72,960 hours from 375,815 to 448,775 hours, as a result of the implementation of 10 CFR 50.65(a)(4). The implementation of this section requires assessing and managing risk associated with maintenance activities as outlined in guidance from Section 11 of NUMARC 93-01, which resulted in a 73,400 burden hour increase. In addition, the decrease in the number of permanently shutdown reactors from 20 to 15 resulted in a 440 hour recordkeeping burden reduction associated with documenting preventive maintenance (400 hours) and periodic assessments (40 hours).

Program Change

The 73,400 hour increase in burden is considered a Program Change, because it resulted from the guidance offered by the agency.

Adjustment

The 440 hour decrease in burden is considered an Adjustment to burden, because the decrease in the number of permanently shutdown reactors did not result from a change in policy or regulations.

This increase is considered to be a Program Change, because it resulted from the change in a requirement due to rulemaking.

This burden increase is considered a Program Change because it resulted from a change in program status to ask licensees to voluntarily submit reactor status and grid information.

Recordkeeping burden has increased by 18,720 (from 50,700 to 69,420 hours) because of the expected addition of 19 combined operating license applicants at 13 reactor sites. The change in burden is because of the expected increase in the number of new applicants. This burden change is considered an Adjustment, because the change does not result from a change to existing agency policy or regulations, but is a result of the industry submitting additional license applications.

The estimated burden has been increased by 2,790 hours based on the actual reporting and ongoing recordkeeping related to plants that have made licensing changes. This is considered a Program Change because the resulting increase in burden is a result of a change of regulations regarding licensing change.

10 CFR 50.70 TEAM INSPECTIONS OF POWER REACTOR LICENSEES

Program Change

Based on past experience, the NRC estimates the burden has increased by 990 hours (from 11,382 to 12,372 hours) due to a revision to IP 71111.21 that increases licensee burden per response by 20% (from 148 to 178 hours burden per response). While the revised IP 71111.21 requests the same amount of information, this information is now further broken down into more detailed information to identify possible component problems and is based on the design of selected components rather than a system. This is estimated to result in additional licensee staff and time to locate the information since their staff and information systems are organized by system, rather than by design. This is considered a Program Change because the burden increase is a result of the revision to policy reflected in the changes made to IP 71111.21.

FINAL SUPPORTING STATEMENT FOR "RISK-INFORMED CATEGORIZATION AND TREATMENT OF STRUCTURES, SYSTEMS, AND COMPONENTS"

Explanation

The NRC anticipates that one licensee annually will choose to implement this voluntary alternative, thereby adding an estimated 3,270 hours annually until the one-time burden requirements have been completed. This burden has decreased by 1,246 hours from 4,516 to 3,270 hours since the initial estimation of the burden in the rulemaking approved on January 10, 2005. For this clearance cycle, NRC staff, based on their experience with this issue, re-estimated the burden at 3,270 hours. (This voluntary change is expected to reduce burden in other current sections of Part 50 because licensees will be choosing to implement the requirements in this section in lieu of the requirements in other current sections; the burden for those sections will be reduced by approximately 1,540 hours.

Program Change

A portion of this burden (+ 3,270 hours) is considered a Program Change because this amount of hours was the unadjusted amount after a change of regulations in 2005.

Adjustment

A portion of this burden (- 4,516 hours) is considered an Adjustment because this section of Part 50 was re-estimated since new regulations were implemented in 2005. The net of the program and adjustment changes is a reduction of 1,246 hours.
