A. Justification.

1. Section 253 of the Immigration and Nationality Act (INA) requires that an alien crewman found to be or suspected of being afflicted with any of the diseases named in section 255 of the INA shall be placed in a hospital for treatment and/or observation as appropriate with the expense of such observation and/or treatment, as well as final removal, being borne by the carrier. The same section requires appropriate guarantee of payment. Section 253.1 of Title 8 of the Code of Federal Regulations specifies Form I-510 for execution of the guarantee of payment required by Section 253 of the INA.

2. The Form I-510 is executed upon each arrival of an alien crewman within the purview of Section 253 of the Immigration and Nationality Act.

  1. The use of this form currently provides the most efficient means for collecting and processing the required data. In this case the U.S. ICE does not employ the use of information technology in collecting and processing information and does not have the automated capability in place to accept electronic submission of this application.

4. There is no duplication of effort, and there is no other similar information currently available that can be used for this purpose.

5. This collection of information does not have an impact on small businesses or other small

entities.

6. This form ensures compliance with Section 253 of the Immigration and Nationality Act that requires the owner, agent, consignee, commanding officer, or master of the vessel or aircraft bare the expense of caring for an alien crewman afflicted with disability or disease. No vessel or aircraft can be granted clearance until such expenses are paid or their payment appropriately guaranteed, and the collector of customs is notified by the immigration officer in charge. This form facilitates this process.

7. There are no special circumstances applicable to this information collection.

8. The U.S. ICE published a notice in the Federal Register on October 23, 2006 at 71 FR 62117. The notice allowed for a 60-day review and comment period. No comments were received.

9. The U.S. ICE does not provide payment or gifts to respondents in exchange for a benefit sought.

10. There is no assurance of confidentiality.

11. There are no questions of a sensitive nature.

Total annual reporting burden is 8. This estimate was derived by multiplying the numbers of respondents (100) x frequency of response (1) x the hours of response (.083 or 5 minutes). This estimation is based on prior experience with the program.

Annual Public Cost

The estimated annual public cost is $80. This is based on the number of respondents (100) x hours per response (.083) x $10 (average hourly rate).

13. There are no capital or start-up costs associated with this information collection. Any cost burdens to respondents as a result of this collection are identified in question 14. There is no fee associated with this information collection.

The estimated cost of the program to the Government is $342. This figure is calculated by using the estimated number of respondents (100) multiplied (x) by 5 minutes (time required to collect and process information) x $40 (suggested average hourly rate for clerical, officer, and managerial time with benefits). In addition, this figure includes the estimated overhead cost for printing, stocking, distributing and processing of this form.

15. There has been no increase or decrease in the estimated number of burden hours reported for this information collection.

16. The U.S. ICE does not intend to employ the use of statistics or the publication thereof for this collection of information.

17. The U.S. ICE will display the expiration date for this information collection.

18. There are no requests for exceptions to the certification of this information collection.
