PHAs are required to submit annual and 5-Year Plans to HUD for tenant-based assistance and operating subsidies. These plans advise HUD, residents, and members of the public of the PHA's mission for serving low-income and very low-income families, and the PHA's strategy for addressing those needs.
The Department is seeking emergency review of the Paperwork Reduction Act requirements contained in the Public Housing Agency Plan. Section 511 of the Quality Housing and Work Responsibility Act of 1998 (P.L. 105-276, 112 Stat. 2461, approved October 21, 1998; 112 Stat. 2461) added a new section 5A to the U.S. Housing Act of 1937 (42 U.S.C. 1437 et seq; see 1437c-1) that introduced the public housing agency (PHA) plans - a Five-Year Plan and an Annual Plan. Through these plans a PHA will advise HUD, its residents, and the public of the PHAÂs mission for serving the needs of low-income and very low-income families, and the PHAÂs strategy for addressing those needs. The PHA Plan process provides an easily identifiable source by which public housing residents, participants in the tenant-based assistance programs, and other members of the public may locate basic PHA policies, rules, and requirements concerning the PHAÂs operations, programs, and services.
This emergency processing is essential to the implementation of the streamlined Public Housing Agency Plan. The new public housing agency (PHA) plan template reduces the administrative burden on PHAs, as well as associated costs, during their time of transition to asset management. PHAs with fiscal year end June 30, 2007, will be the first group of agencies to use the new streamlined template, which is to be submitted 75 days prior to a PHAÂs fiscal year end.
Section 5A of the United States Housing Act of 1937 states that HUD, by regulation, may exempt certain elements from review and has done this by regulation at 24 CFR 903.23(b). This section limits HUD scope of review of the Annual Plan (and any significant amendments or modifications to the plan) to information required by 903.7(b) statement of the PHAÂs deconcentration and other policies that govern eligibility, selections, and admissions; 903.7(g) statement of capital improvements; 903.7(h) a statement of any demolition and/or disposition; 903.7(o) Civil Rights and any other element of the PHAÂs Annual Plan that is challenged. This collection allows for PHAs to submit for HUD review only those Plan elements required by law and/or regulation to the key elements described above. Consequently, the Annual Plan submitted by all PHAs need only address policies concerning deconcentration and other eligibility requirements (including selection and admissions), capital improvements, demolition and disposition and civil rights certification.
To permit implementation of the changes in the streamlined template, the form HUD-50075 is revised to consolidate all program types and sizes. This revision to form HUD-50075 eliminates the following PHA Plan templates, form HUD-50075-SF, HUD-50075-SA, and form HUD-50075-Small used for small PHAs and High Performing PHAs. The new annual plan template design and submission process helps to facilitate HUDÂs goal of transitioning public housing to an asset management concept, in accordance with 24 CFR Part 990.
PHAs, with the new streamlined plan template, will simply indicate by checking Âyes or Âno whether or not element(s), in their last approved annual plan, is being updated with the current Annual Plan submission cycle. If an element(s) is updated, the PHA will check Âyes ensuring that updated elements(s) is available to the general public via the web, at the main office of the PHA, PHA development management offices, or public library. The new Annual Plan template streamlines the process for PHAs, having only to indicate whether or not an element(s) is being updated and submit to HUD only those plan content documents required by law and regulation.
