SUPPORTING STATEMENT




1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


Form 8886-T, Disclosure by Tax-Exempt Entity Regarding Prohibited Tax Shelter Transaction, was developed to carry out the provisions which require certain tax-exempt to file Form 8886-T to disclose information for each prohibited tax shelter transaction to which the entity was a party.


2. USE OF DATA


Form 8886-T will provide eligible tax-exempt entities a standardized format to disclose the information.

  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


Upon approval, there are no current plans to offer electronic filing on Form 8886-T.


4. EFFORTS TO IDENTIFY DUPLICATION


We have attempted to eliminate duplication within the agency

wherever possible.


5. METHODS TO MINIMIZE BURDEN ON SMALL BUSINESSES OR OTHER SMALL ENTITIES

6. CONSEQUENCES OF LESS FREQUENT COLLECTION ON FEDERAL PROGRAMS OR POLICY ACTIVITIES

Periodic meetings are held between IRS personnel and

representatives of the American Bar Association, the National Society of Public Accountants, the American Institute of Certified Public Accountants, and other professional groups to discuss tax law and tax forms. During these meetings, there is an opportunity for those attending to make comments regarding Form 8886-T.

We will publish a notice in the Federal Register in the near future to solicit public comments on Form 8886-T.

RESPONDENTS

Generally, tax returns and tax return information are

confidential as required by 26 USC 6103.

After consultation with various functions within the Service, we have determined that the cost of developing, printing, processing, distribution and overhead for the form is $5,000.

A submission needs to be made on an emergency basis because temporary regulations are about to be issued under section 6033(a)(2) that require taxpayers to file this form. ICR 200704-1545-051 is currently pending approval from OMB.
