The EPA is proposing revisions to the regulations governing State operating permit programs for major sources mandated by title V of the Clean Air Act (CAA) to clarify approaches that may be used to create flexible permits. With a flexible title V permit, the source may make authorized physical and operational changes without further review or approval.
Along with accompanying changes to the regulations governing the major New Source Review (NSR) program mandated by parts C and D of title I of the CAA, the proposed clarifications are intended to provide increased operational flexibility to sources while ensuring as good or better environmental protection as under the existing regulatons. The proposed changes represent a potential decrease in burden to sources and States and local permitting authorities related to permit actions. While we believe that most permitting authorities will be able to implement the flexible permitting approaches without revising their operating permit programs, the changes may also represent a one-time increase in burden to some States and other permitting authorities to revise their operating permit programs.
As a result of the proposed revisions to clarify the operating permit program regulations, sources that obtain a flexible permit (after the initial burden of voluntarily obtaining the permit) will subsequently be able to make authorized changes without revising their permits, thereby reducing the burden that would have resulted from those permit actions in the absence of the flexible permit. We estimate that 10% of sources will obtain a flexible permit that incorporates advance approval for NSR, and that these sources will then be able to forego one additional significant permit modification every 5 years and nine additional minor permit modifications per year. We estimate that an additional 20% of sources will obtain a simpler flexible permit that does not involve advance approval for NSR, and that these sources will then be able to forego two additional minor permit modifications per year.
State and local reviewing authorities will first incur added burden to revise their major NSR programs to provide for Green Groups. Subsequently after issuing a Green Group permit, their burden will be reduced as a result of the reduction in the number of major and minor NSR permits processed for the source with a Green Group.
