Other change**: The TQE regulations (34 CFR Part 611, Subpart A, Sec. 611.1) definition of a “high-need LEA” has reduced the poverty threshold for schoolwide program schools from 50 percent eligibility for free and reduced-price lunch subsidies to 40 percent. This change is consistent with the poverty threshold in No Child Left Behind Act of 2001 (PL 107-110, Title I, Part A, Subpart 1, Sec. 1114).


This change is noted in the definition of a “high-need school district” on page 5 of the Teacher Quality Enhancement Programs Title II, Higher Education Act (HEA) Scholarship Terms and Conditions Form, and on page 3 of the Teacher Quality Enhancement Programs Title II, Higher Education Act Verification of Teaching Obligation Form.

34 CFR Part 611, Subpart A, Sec. 611.1(1)(i): High-need local educational agency (LEA) means an LEA that meets one of the following definitions: (1) an LEA with at least one school (i) In which 50 percent or more (CHANGE to 40 percent or more) of the enrolled students are eligible for free and reduced lunch and subsidies.
