SUPPORTING STATEMENT

A. Justification:


1. 47 CFR 73.1740 requires licensees of commercial broadcast stations to notify the FCC in Washington, D.C., when events beyond their control make it impossible to continue operation or to adhere to the required operating schedules set forth in this section. In addition, the FCC must be notified when normal operation is resumed. No further authority is needed for limited operation or discontinued operation for a period not exceeding 30 days. Should events beyond the licensees control make it impossible for compliance within the required 30-day time period, an informal written request shall be submitted to the FCC requesting the amount of additional time that the licensee deems necessary.


As noted on the OMB Form 83-I, this information collection does not affect individuals or households; thus, there are no impacts under the Privacy Act.


Statutory authority for this collection of information is contained in Section 154(i) of the Communications Act of 1934, as amended.


2. The data is used by FCC staff to temporarily authorize a limited operation or a discontinuance of operation.


3. This is a simple notification requirement. The Commission will accept notification via e-mail.


4. No other agency imposes a similar information collection on the respondents. There is no similar data available.


5. This notification requirement does not impose any significant impact on small businesses.


6. In conformance with the Paperwork Reduction Act of 1995, the Commission is making an effort to minimize the burden on all respondents. This information collection is minimal and is only utilized when the station cannot operate on its regular schedule.


7. This collection of information is consistent with the guidelines in 5 CFR 1320.5(d)(2).


8. The Commission published a Notice (72 FR 44533) in the Federal Register on August 8, 2007. No comments were generated as a result of the Notice.


9. No payment or gift was provided to respondents.


10. There is no need for confidentiality.


11. This collection of information does not address any private matters of a sensitive nature.


12. We estimate that 368 licensees would notify the FCC of limited/discontinued operation of broadcast stations and when normal operations are resumed. The average burden on licensee is 0.25 hours per notification. This estimate is based on FCC staff's knowledge and familiarity with the availability of the data required.

Total Number of Annual Responses:

368 licensees x 2 notifications/licensee = 736 responses/notifications


Total Annual Burden Hours: 736 notifications x 0.25 hours/notification = 184 hours



Annual In-House Cost: We assume that either the chief engineer or general manager would prepare the notifications. We estimate that their average hourly salary is $26.

Total Annual “In-House” Cost:

736 notifications x 0.25 hours/notification x $26/hour = $4,784

14. Cost to the Federal Government: The Commission will use professional staff at the GS-11 level ($30.25/hour) to process these notifications. The processing time is 5 minutes (0.084 hours) per notification.


Total Cost To the Federal Government:

736 notifications x 0.084 hours/notification x $30.25/hour = $1,870.18


15. There are no program changes or adjustments.


16. The data will not be published.


17. OMB approval of the expiration date of the information collection will be displayed at 47 C.F.R. Section 0.408.


18. There are no exceptions to the Certification Statement in Item 19.
