Persons importing, exporting, and conducting international transactions with List I and List II chemicals must notify DEA of those transactions in advance of their occurrence, including information regarding the person(s) to whom the chemical will be transferred and the quantity to be transferred. For importations, persons must also provide return declarations, confirming the date of the importation and transfer, and the amounts of the chemical transferred. This information is used to prevent shipments not intended for legitimate purposes.
This is a request for emergency processing of two information collections associated with a Drug Enforcement Administration (DEA) Final Rule ÂChanges in the Regulation of Iodine Crystals and Chemical Mixtures Containing Over 2.2 Percent Iodine [Docket No. DEA-257, RIN 1117-AA93]. DEA notes that this Final Rule is being finalized with a 30-day effective date. The two collections for which emergency processing is requested are: ÂApplication for Registration under Domestic Chemical Diversion Control Act of 1993 and Renewal Application for Registration under Domestic Chemical Diversion Control Act of 1993 [OMB information collection 1117-0031] and ÂImport/Export Declaration for list I and List II Chemicals [OMB information collection 1117-0023].

"Import/Export Declaration for List I and List II Chemicals" [1117-0023] contains two information collection instruments. One, the DEA- Form 486, is completed on an as-needed basis by persons wishing to import, export, or conduct international transactions involving these chemicals. The other is a quarterly report completed by certain persons for the importation of three specific List II chemicals.
When DEA renewed this collection, it inadvertently double-counted the burden associated with the quarterly report, counting it both in the quarterly instrument and the as-needed instrument.
This change request corrects that double-counting.
