Application for TV Broadcast
Station License; Application for Construction Permit for Reserved
Channel Noncommercial Educational (NCE) Broadcast Station;
Application for Authority to Construct or ....
FCC Form 302-TV is used by
licensees/permittees of TV broadcast stations to obtain a new or
modified station license and/or to notify the Commission of certain
changes in the licensed facilities. Form 302-DTV is used by
licensees/permittees of DTV stations to obtain a new/modified
station license, and/or to notify the FCC of certain changes in the
licensed facilities of those stations. FCC 340 is used to apply for
authority to construct a new NCE FM, TV, and DTV broadcast station,
or to make changes in the existing facilities. FCC Form 349 is used
to apply to authority to construct a new FM translator or FM
booster broadcast station, or to make changes in the existing
facilities of such stations. On 4/25/2007, the FCC adopted the
Notice of Proposed Rulemaking (NPRM), MB Docket 07-2, FCC 07-70, to
consider the procedures and rule changes necessary to complete the
nations's transition to DTV, including how best to ensure that
broadcasters complete construction of their facilities on their
final, post-transition (digital) channel by the statutory deadline.
FCC Form 340 is being revised to accommodate the filing of
applications to construct or modify post-transition facilities. The
NPRM proposes that stations that have applied to construct or
modify post-transitions facilities must use the FCC Form 302-DTV to
obtain a new or modified station licensees to cover those
post-transition facilities.
The DTV transition these
collections are associated with affects virtually every segment of
the television industry and every American who watches television.
Congress has mandated that after February 17, 2009, full-power
television broadcast stations must transmit only digital signals
and may no longer transmit analog signals. The Commission has no
discretion to waive or change this statutory deadline. These
information collection requirements are critical to ensure that
full-power television broadcast stations meet their statutory
responsibilities and can begin operations on their final,
post-transition (digital) channels by their construction deadlines.
Stations that are not ready to commence digital operations upon
expiration of the statutory transition deadline may be forced to go
dark, potentially resulting in significant loss of television
service to the American public and significant harm to the
broadcast TV industry and the U.S. economy. In addition, the DTV
transition will enable the recovery of spectrum for critically
important public safety needs and new wireless services. The
Commission also notes that the public and OMB have had the
opportunity to review these collections at the NPRM stage and that
these collections, as adopted, have not been changed since their
previous submission at the NPRM stage. Emergency OMB approval is
necessary for this collection to ensure that full power television
stations are able to complete their transition from analog to
digital service by February 17, 2009. For stations that must apply
for a construction permit to build their post-transition
facilities, it is essential that the procedures and forms be
effective and available for filing no later than January 2, 2008 to
afford adequate time for ordering equipment and scheduling
construction in time to meet this deadline. Because these forms
have previously been submitted to OMB and because any delay can
result in harm to television stations, and, in turn, to their
viewers, we find that there is good cause to expedite the effective
date of this rule and obtain emergency PRA approval from OMB.

The Commission adopted a Notice
of Proposed Rulemaking, MB Docket No. 07-91, FCC 07-70. The NPRM
proposes that noncommercial television stations must use the
proposed revised FCC 340 and also use the unchanged FCC Form
302-DTV to accommodate the filing of post-transition applications.
This program change will increase the annual burden by 2,130 hours
and the cost burden by $1,447,000. There is also an adjustment to
this information collection due to the consolidation of OMB Control
Number 3060-0837 into collection 3060-0029 which will increase the
annual burden hours by 1,650 hours and the cost burden by 255,000.
The total increase to this information collection is 3,780 burden
hours and $1,702,000 cost burden.
