NEZ PERCE RESERVATION AIR QUALITY PERMIT : FORESTRY BURN
INSTRUCTIONS, TERMS & CONDITIONS
Permit applicants are required to adhere to the following requirements. After sending in an Air Quality Permit
Application and receiving approval, this signed sheet is your permit and you must keep it available and provide it
upon request to Nez Perce Tribe or US EPA inspectors. 40 CFR 49.134 Forestry and Silvicultural Burning Permits

General Terms and Conditions
1. Applicants can obtain permit forms from the Nez Perce Tribe (NPT) Air Quality Office, Idaho
Department of Lands (IDL) or online at www.epa.gov/r10earth/FARR.htm or www.nezperce.org.
a. Permit applications must be submitted to the NPT Air Quality Office via fax or received in the
mail at least five working days, but not later than one working day, prior to the desired burn
date.
b. Nez Perce Reservation Forestry Burning Permits cost $0 per permit. Fees must be paid to
the NPT Air Quality Office prior to burning.
c. Please apply early to ensure all documents are in place prior to requesting to burn.
2. Applicants must request and receive burn approval from the US EPA or the NPT Air Quality Office.

3. Applicants are responsible for compliance with any applicable burn safety requirements and must
also obtain applicable fire safety permits. Idaho Department of Lands permits are required to burn
between May 10th and October 20th. Contact your local fire district or sheriff’s office for other permit
information.
4. Applicants are responsible for compliance with any applicable burn safety requirements and for
shutting down burns when necessary and/or requested to do so by the NPT Air Quality Office or
US EPA. Factors taken into consideration in deciding whether a burn should be shut down include:
a. Wind speed, direction, or sudden shifts
b. Extended or extremely high levels of particulate matter on air monitors
c. Fire safety and control
d. Proximity to canyon rims, roadways, towns, houses, businesses, and other sensitive
populations
5. Applicants are responsible for conducting test burns, especially near sensitive areas (canyon rims,
near towns and houses), and must have flaggers stationed for burns affecting roadways.
6. Applicants must call the NPT Air Quality Office with post burn information.
7. Applicants are responsible for following all procedures and guidelines regarding forestry burning on
the Nez Perce Reservation.

Burn Call Procedures the Day Preceding the Burn Day
1. After applications are in and complete, applicants should call the NPT Air Quality Office to request
to burn no later than 2:00 PM. prior to the day of the desired burn (Please note: calling by 2:00 PM
does not guarantee a next day burn approval). Applicants may leave a voicemail.
2. The following burn information must be supplied:
a. Name and contact phone number
b. Burn permit number
c. Type and size of burn(s) (e.g. how many piles, dimensions, footage or acreage).
d. Location of the burn (County, Township, Range, Section, & Quarter Section or
address if at a residential or commercial business site).
e. Other pertinent information (e.g. canyon rim, near highway, near a town, etc.)
3. Nez Perce Tribe burn managers review requests between 2:00 and 3:30 PM to determine the
preliminary recommendation for the burn area(s). Burn priority will be as follows:
a. Favorable conditions for sensitive areas (near towns, roads, canyons)
b. The preferred area to be burned (in terms of forecasted conditions).
c. The order of burn requests received from applicants.
4. Pre-approved applicants will receive a preliminary decision by telephone by 4:00 PM. A telephone
message will be left if there is no answer.
Burn Call Procedures on the Burn Day
1. If the preliminary burn decision changes due to poor air quality and/or updated forecast information,
the NPT Air Quality Office will call pre-approved applicants by 9:15 AM.
Note: Applicants must be reachable by phone or other means of communication during the day of
the burn should there be a change in the burn decision and if it necessary to cease all burning. If
applicants are not reachable and continue burning, they are in violation of the permit.
2. If preliminary burn decisions do not change, the NPT Air Quality Office will not call applicants.
3. The applicant must call the NPT Air Quality Office before ignition to find out if any changes have
occurred in conditions for the day and to allow the office to track which fires are being burned, the
time they are ignited and where the fires are located.
Note: If the NPT Air Quality Office is unable to answer the phone, applicants may leave a message
that they are lighting and the time of ignition.
Post-Burn Procedures
1. Within 24 hours after the burn, the applicant must contact the NPT Air Quality Office with post burn
information and leave the following:
a. Name
b. Date and time of the completed burn
c. How the burn went and if it is still smoldering
d. What was actually burned

2. Applicants may leave a telephone message, mail or fax the post burn information.
Note: If an applicant does not submit the post burn information, then the applicant will be out
of compliance with permit conditions and may drop in priority for subsequent burns.
The public reporting and recordkeeping burden for this collection of information is estimated to average
one hour per response. Send comments on the Agency’s need for this information, the accuracy of the
provided burden estimates, and any suggested methods for minimizing respondent burden, including
through the use of automated collection techniques to the Director, Collection Strategies Division, U.S.
Environmental Protection Agency (2822T), 1200 Pennsylvania Ave., NW, Washington, D.C. 20460.
