A. Justification


1. Goods are entered for exhibit free of duty under the legal authority of the Tariff Schedules of the United States (19 U.S.C. 1752) and under the administrative procedures of 19 CFR 147.11(c). This part governs the entry of merchandise intended for exhibit or use in constructing, installing, or maintaining foreign exhibits at trade fairs which has been so designated by the Secretary of the Commerce.


2. All entries for exhibit are made at the port of entries by the fair operators to U.S. Customs and Border Protection (CBP) to substantiate when an exhibit is approved by the Department of Commerce. The information is used to control goods which enter through the borders of the United States. If the entry was not made, there would be a lack of control over such importations.


3. Automation of this collection of information is planned for the Automated Commercial Environment (ACE) for 2011.


4. Since the information for each entry is unique, the information is not duplicated elsewhere.


5. This information collection does not significantly impact small businesses or other small entities.


6. The consequence to the Federal program if this information were not collected would cause a loss of control over the imported merchandise.


7. This information collection is conducted in a manner that is consistent with the guidelines in 5 CFR 1320.5(c)(2).


8. Public comments were solicited through two Federal Register notices published on January 23, 2008 (Volume 73, Pages 3984-3985) and on March 25, 2008 (Volume 73, Page 15761). As of this submission no comments have been received.

11. There are no questions of a personal or sensitive nature on this declaration.


12. Estimated Annualized Burden on the Public. The estimated burden for this information collection is 530 hours, based on an estimated 40 respondents who average 40 responses for a total of 1,600 responses. Each response is estimated to require .333 hours (20 minutes).


Estimated Annualized Cost on the Public. The total cost to the public is estimated to be $10,672.20, based on 462 burden hours at an average hourly cost of $23.10.

13. Estimated Capitalization Cost Burden on the Public. There are no capitalization cost associated with this collection.


14. Estimated Annualized Cost to the Federal Government. The annual estimated cost to the Federal Government associated with collecting, processing, and analyzing the information on the declaration is $2,450.00. This is based on an estimated 70 hours expended at an average hourly rate of $35.00 per hour.


15. There are no changes to this information collection.


16. This information collection will not be published for statistical purposes.


17. This collection does not involve a form so there is no printed expiration date.


18. There are no exceptions to the certification statements identified in Item 19 on the 83-i.
