Data Relating to Beneficiary of Private Bill

A. JUSTIFICATION:

  1. General Requirement. Section 212 of the Immigration and Nationality Act (INA) identifies classes of alien not eligible for admission into the United States. The information obtained from the information collection is used to prepare a report to the appropriate Congressional Committee (Senate or House of Representatives) and advise whether a person for whom a Private Bill has been introduced is or is not in violation of Section 212 of the INA.


  1. Purpose of Collection. This form will be used by the U.S. Immigration and Customs Enforcement (ICE) to obtain information from beneficiaries and/or interested parties in Private Bill cases when requested to report by the Committee on the Judiciary.

  2. Information Technology. The use of this form provides the most efficient means for collecting and processing the required data. In this case the ICE does not employ the use of information technology in collecting and processing information; however, ICE will be meeting with appropriate officials discussing feasibility of e-filing for this collection. At this time ICE is trying to obtain approval to avoid a lapse in the authorized us of this form.

  3. Duplication of Effort. A review of the ICE Forms Inventory Report revealed no duplication of efforts. There is no similar information currently available that can be used for this purpose.

  4. Impact on Small Business. This collection of information does not have an impact on small businesses or other small entities.

  5. Importance of Collection. If the information is not collected, the ICE has no means by which to report to Congress the required information relative to Section 212 of the INA and the beneficiary of a Private Bill.

  6. Special Circumstances. The special circumstances contained in Item 7 of the Supporting Statement are not applicable to this information collection.

  7. Public Comments. The ICE published a 60 notice in the Federal Register on December 11, 2007. 72 FR 70337. The notice allowed for a 60-day public review and comment period. No comments were received.

  8. Payment or Gifts. The ICE does not provide payment or gifts to respondents in exchange for a benefit sought.

  9. Assurance of Confidentiality. There is no assurance of confidentiality.

  10. Questions of a Sensitive Nature. There are no questions of a sensitive nature.

Annual Reporting Burden

Total annual reporting burden hours is 100. This figure was derived by multiplying the number of respondents (100) x frequency of response (1) x hours per response (1). The projected hours per response for this collection of information were derived by first breaking the process into three basic components:

Learning about the Law and the Form: 10 Minutes

Completing the Form: 40 Minutes

Assembling and Filing the Form : 10 Minutes

For the first two components, we used tests to determine completion times. People who were not conversant with immigration processes were used to determine average completion time. The third component of the process “Assembling and Filing the Form” was broken down into subtasks. For example, the form can be mailed to an ICE office or filed in person. Thus the time necessary to actually file the form can vary widely depending on the circumstances of the applicant.

Public Cost

The estimated annual public cost is $1,000. This is based on the number of respondents 100 x 1 Hour per response x $10 (Average hourly rate).

  1. Start-Up Costs. There are no capital or start-up costs associated with this information collection. Any cost burdens to respondents as a result of this information collection are identified in Item 14. Additionally, there are no fee charges associated with the collection of this information.

Government Cost

The estimated cost to the Government is $2,100. This figure is calculated by using the estimated number of respondents 100 x 30 minutes (0.5) (Time required to collect and process information) x $40 (suggested average hourly rate for clerical, officer, and supervisory time with benefits). In addition, this figure includes the estimated overhead cost for printing, stocking, and distributing the form, which is $100.

  1. Change in Burden Hours. There has been no increase or decrease in the estimated burden hours previously reported for this information collection.

  2. Published Results. ICE does not intend to employ the use of statistics or the publication thereof for this information collection.

  3. Expiration Date Display Waiver. ICE is not seeking approval of a waiver to display the expiration date of March 31, 2009 OMB approval of this information collection.

  4. Certification Exception. The ICE does not request an exception to the certification of this information collection
