EPA is amending the list of hazardous
wastes from non-specific sources under 40 CFR 261.31 by modifying
the scope of EPA Hazardous Waste No. F019, which currently reads:
"Wastewater treatment sludges from the chemical conversion coating
of aluminum except from zirconium phosphating in aluminum can
washing when such phosphating is an exclusive conversion coating
process." EPA is amending the F019 listing to exclude wastewater
treatment sludges generated from zinc phosphating, when zinc
phosphating is used in the motor vehicle manufacturing process,
provided that the wastes are not placed outside on the land prior
to shipment to a landfill for disposal, and the wastes are disposed
in a landfill unit that meets certain liner design requirements. In
addition, EPA is requiring the generators of these wastes to keep
records showing that their wastes were disposed in a landfill that
meets the specified liner design requirements.

EPA is amending the F019
listing to exempt wastewater treatment sludges generated from zinc
phosphating, when zinc phosphating is used in the motor vehicle
manufacturing process, provided that the wastes are not placed
outside on the land prior to shipment to a landfill for disposal,
and the wastes are disposed in a landfill unit that meets certain
liner design requirements. The increase in burden would result from
the need for F019 sludge generators and potential generators to
read the rule that amends the F019 listing. In addition, the
generators would also be required to maintain documentation and
information sufficient to prove that the wastewater treatment
sludges to be exempted from the F019 listing meet the conditions of
the listing. The total increase in new annual paperwork
requirements in the final rule is approximately 35 hours. However,
in addition to the new paperwork requirements for respondents, the
final rule would result in annual respondent burden savings under
the existing paperwork requirements (associated with two existing
EPA ICRs) of approximately 480 hours. Taking both the new and
existing RCRA requirements into account, the final rule would
result in a net reduction in annual paperwork burden of
approximately 440 hours.
