SUPPORTING STATEMENT

This is being submitted as an extension of an existing collection.


  1. Justification:


1. Pursuant to 47 CFR 43.21(c), each miscellaneous common carrier with operating revenues in excess of the indexed threshold as defined in § 32.9000 must file a letter showing its operating revenues for that year and the value of its total communications plant at the end of that year. The letter must contain information pertaining to the carrier’s revenues and plant. These letters must be filed by no later than April 1 of the following year. Those miscellaneous common carriers with annual operating revenues that equal or surpass the indexed revenue threshold for the first time may file the letter up to one month after publication of the adjusted revenue threshold in the Federal Register, but in no event shall such carriers be required to file the letter prior to April 1.


As noted on the OMB Form 83i, this information collection does not affect individuals or households; thus, there are no impacts under the Privacy Act.


Statutory authority for this information collection is Sections 1, 4(i), 4(j), 201-205, 218, 226, and 303(r) of the Communications Act as amended; 47 U.S.C. sections 151, 154(i), 154(j), 201-205, 218, 226 and 303(r).


  1. The information is used by the FCC staff for regulatory or compliance purposes and by the public to analyze the industry.


  1. Use of improved information technology to reduce burden is not under consideration since it is unlikely to be beneficial to the respondents or the Commission because of the minimum amount of information requested.


  1. The revenue information is collected elsewhere, but on a proprietary basis. No similar information is available on plant.


  1. The collection is designed to minimize the burden on all carriers regardless of size.


  1. Timely data are necessary for the Commission to effectively monitor growth and changing dynamics in the long distance industry and in the international communications industry.


  1. The collection of information is not being conducted in any manner known to be inconsistent with the guidelines in 5 CFR 1320.5.


  1. Pursuant to 5 CFR 1320.8(d), the Commission published a notice in the Federal Register to solicit comments on May 21, 2008 (73 FR 29512). No comments were received. The notice is referenced in the submission to the OMB.


  1. Not applicable. The Commission does not anticipate providing any payments or gifts to respondents.


  1. Confidential information is not solicited. Persons who believe that the requested data are confidential information may request confidential treatment under the Commission’s rules, see 47 CFR 0.459.


  1. The collection of the data does not contain questions of a sensitive nature.


  1. The following represents the estimate of hourly burden of the collection of information:

  1. Number of respondents: 27.

  2. Frequency of response: Annual reporting requirement.

  3. Estimated time per response: 1 hour.

  4. Total annual hourly burden: 27 hours.

  5. Estimate of annualized cost to respondents for the hourly burden for collection of information to be under $100.

  6. Explanation of calculation: We assumed that the respondents use personnel comparable in pay to a clerk/typist, GS-4/5 in the federal service. Thus, cost to respondent associated with the letters filed by miscellaneous common carriers is $55.56 (see item #14 below).


  1. The following represents the Commission’s estimate of the annual cost burden to respondents or record keepers resulting from the collections of information:


  1. Total capital and start-up cost component (annualized over its useful life): $0.

  2. Total operations and maintenance and purchase of services component: $0.


  1. The cost to the government for this information collection is estimated to be under $100. Cost associated with the letters filed by miscellaneous common carriers is $55.56, based on a clerk-typist, GS-4/5 in the federal service, expending 4 hours to generate form letters, to send them to the affected companies and to file the letters when they arrive.


  1. The decrease in the hourly burden is due to less applicants (fewer respondents) filing the annual letter.


  1. The data filed are made available to the public upon arrival.


  1. The Commission does not seek approval not to display the expiration date for OMB’s approval of the information collection.


  1. There are no exceptions for this submission.


  1. Collection of Information Employing Statistical Methods:
