12 USC 1759(c)(2), (Section 109 of the
Federal Credit Union Act), specifically provides for an exception
for underserved areas if the NCUA Board determines that a local
community, neighborhood, or rural district is an investment area,
is underserved based on NCUA and federal banking agency data, and
if the credit union establishes an office in the underserved area.
NCUA, as the regulatory agency for federal credit unions, has the
supervisory responsibility to ensure the requirements are
met.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
