OMB understands that DOJ believes that BJS is required by law to produce estimates for this new collection on a specific timetable. However, it is critical for new statistical collections to be tested and for the results to be evaluated adequately. Given timing and funding limitations, OMB expects BJS to characterize the year one data collection as a pilot program, to procure the services of an independent evaluator as planned as soon as practicable, and to revise year two and subsequent collections as warranted. To ensure that these activities are carried out in a timely fashion, OMB is clearing this collection for only 20 months, rather than the requested 36 months.

The information collected will be used to evaluate the degree of completeness of states’ submission of specified records to the Attorney General. The NICS Improvement Amendment Act has provisions that require states to meet specified goals for completeness of the records submitted on individuals prohibited by federal law from possessing firearms in order to receive a waiver of a matching funds requirement associated with the National Criminal History Improvement Program (NCHIP) and/or to avoid withholding of federal grant funds under the Byrne Justice Assistance Grant (JAG) program. The Act provides incentives for states to meet the goals it sets for greater record completeness.
