Report of Multiple Sale or Other Disposition of Pistols and Revolvers

Justification
1. Title 18, United States Code 923 (g) (3) provides that “Each licensee shall prepare a report of multiple sales of other dispositions whenever the licensee sells or otherwise disposes of, at one time or during any five consecutive business days, two or more pistols, or revolvers, or any combination of pistols or revolvers totaling two or more, to an unlicensed person.” The report shall be prepared on ATF F 3310.4, Report of Multiple Sale or Other Disposition of Pistols and Revolvers. It is pertinent that the Multiple Sale or Other Disposition Report was originally a regulatory requirement that was incorporated into the Gun Control Act when it was amended in 1986.
The form has been revised to allow for multiple disposition dates. Also, input fields have changed to more accurately reflect the information that is required. Please note the new information that has been added to the form.

2d. to cover gun show information on gun show sales.
Handguns Acquired in the Last Five Business days has had a column added for disposition date.
Race category has been changed to comply with the Standards for the Classification of Federal Data on Race and Ethnicity.
The information for numbers 13, 14a, 14b, 15, 16, and 17 is new.
The instructions have been changed to include the following:
1. Added a sentence indicating that the form is not required for pistols or revolvers returned to the same person from whom received.
2. Clarifies the 5 consecutive business days and the need for a new form once the first multiple has been sent in and additional guns are purchased. Also includes the instructions for 2c.
3. Explains when and how Items 4 and 13 should be completed when it is a corporation, company, association, partnership or other such business entity and an officer completes the purchase.
5. Instructs on what numbers should be completed by the FFL.
6. Gives the information on where copies 1, 2, and 3 should be sent or kept. Shows updated address and phone.
The form is no longer formatted as a self-mailer. The time to complete the form has increased and the number of respondents has increased. This concludes the revisions for this submission.

2. These reports of multiple sales or other dispositions are used by ATF as a means to discern patterns in the purchase of firearms that may end up in the interstate trafficking of illegal firearms. The information is used to determine if the buyer (transferee) is involved in a unlawful activity, or is a person prohibited by law from obtaining firearms. The report shall be prepared not later than the close of business on the day that the multiple sale or other disposition occurs.
3. This information collection is now available on the ATF website as a fillable form. The respondent must either fax or mail the form to the ATF National Tracing Center.
4. ATF uses a subject classification code on all forms. This code ensures that there is no duplication of information. Similar information is not available elsewhere for this information collection requirement.
5. The collection of information does not have any impact on small business or other small entities.
6. The consequence of not conducting this information collection would pose a threat to public safety. The information collection documents certain sales or other dispositions of handguns for law enforcement purposes.
7. There are no special circumstances for this information collection and it is in conformance with the guidelines of 5 CFR 1320.6
8. The ATF National Tracing Center and ATF Chief Counsel were consulted for this information collection. The information requested is mandatory and required by statute (18 U.S.C. 923 (g) (3)). A 60-day and 30-day notice was published in the Federal Register to solicit comments from the general public. No comments were received.
9. No payment or gift is associated with this collection.
10. Respondent’s confidentiality is not assured.
11. No questions of a sensitive nature are asked.
12. The estimated number of respondents is 61,000. The frequency of responses is 4 per respondent per year. The total number of responses is 244,000. The annual burden is 4 x 244,000 x 15 minutes to complete the form = 61,000 hours.
13. It is estimated that three fourths fax their response. Therefore, the cost burden for #14. 83-I will be shown as 0.

15. The changes to the form are due to an adjustment in agency estimate. There is an increase in the number of respondents from 10,000 to 61,000. The time to complete the form has increased from 12 minutes to 15 minutes. The total burden has increased from 8,000 to 61,000. The difference of the increase from the previous submission is 53,000.
16. The results of this information collection will not be published.
17. ATF does not request approval to not display the expiration date for OMB approval of the information for this collection.
18. There are no exceptions to the certification statement.
