The Labor-Management Reporting and Disclosure Act (LMRDA) requires unions to file annual financial reports, and copies of their constitution and bylaws with DOL. Under certain circumstances, reports are required of union officers and employees, employers, labor relations consultants, and surety companies. All reports are available for public disclosure. Filers are required to retain supporting records for five years; unions are required to retain election records for one year.

The promulgation of the final LM-2 / LM-3 final rule for 29 C.F.R. Parts 403 and 408 (RIN 1215-AB62) is projected to result in an increase of 761,153 annualized burden hours (from 4,289,970 to 5,051,123), all of which is attributable to a program change. The increase in burden arises from revised reporting requirements for the Form LM-2 and new revocation procedures for the Form LM-3 and is necessary in order to provide improved financial transparency for union members as contained in the Labor-Management Reporting and Disclosure Act (29 U.S.C. 401 et. seq.) and explained in the preamble to the aforementioned final rule. The burden associated with the new revocation procedures for the Form LM-3 is included in the Form LM-2 burden as labor organizations who previously filed a Form LM-3 with deficiencies will have to file a Form LM-2.
