Justification for Change

JUSTIFICATION FOR CHANGE

Defense needs to make some last minute changes to the DD Form 294 that OMB approved under emergency submission on December 31, 2008. At or near the time of OMB approval, the GC, DoD reversed previous determinations. More importantly the correct interpretation of the retroactivity provision of the underlying statute was brought to our attention.

The addition of the Coast Guard will not change the burden.

The proposed changes are outlined as follows for the DD Form 294:

Block 1 a add COAST GUARD (and block to check)

Block 5 b delete the current second to last sentence and substitute the following " If No, explain in item 14. See item 5 of instructions for pending determinations"

Page 3

Item 5 next to last current sentence delete the word "awarded" and replace with "with an effective date ". Same sentence add "Enclosure 3" following "6040.44"

Add the following sentence to end of item 5 (following the sentence that ends in a parenthesis) . "Delay submitting this application if you want the PDBR to consider a pending VA rating; it will not reconsider a case".
