JUSTIFICATION FOR CHANGE IN AN OMB CLEARANCE PACKAGE

3150-0203


The Nuclear Regulatory Commission (NRC) amended its regulations to include jurisdiction over discrete sources of radium-226, accelerator-produced radioactive materials, and discrete sources of naturally occurring radioactive material, as required by the Energy Policy Act of 2005 (EPAct), which was signed into law on August 8, 2005. This provided a regulatory framework by which to license and regulate byproduct material in accordance with the new, expanded definition. The amended regulations impacted numerous existing NRC information collections. The NRC packaged all the impacted information collections into one new information collection which OMB approved and assigned control number 3150-0203.


In 2008, NRC submitted 83-C’s to transfer burden from 3150-0203 to the correct clearances to include the following collections: 10 CFR Part 20 (3150-0014); 10 CFR Part 30 (3150-0017); 10 CFR Part 31 (3150-0016); 10 CFR Part 32 (3150-0001); and NRC Form 313 (3150-0120). These requests were approved by OMB in October 2008.


The purpose of this 83-C is to transfer all remaining burden associated with 3150-0203, “10 CFR Parts 20, 30, 31, 32, &35, Requirements for Expanded Definition of Byproduct Material, Final Rule and NRC Forms 4, 5, 313, 314, & 664,” to the appropriate existing OMB clearances to include the following collections: 10 CFR Part 19 (3150-0044); 10 CFR Part 35 (3150-0010); NRC Form 4 (3150-0005); NRC Form 5 (3150-0006); NRC Form 314 (3150-0028); and NRC Form 664 (3150-0198). NRC seeks to change the burden and responses in clearance 3150-0203 to zero, and to add the burden and responses to the existing control numbers associated with each clearance. The transfer of this burden from 3150-0203 will not change the NRC’s overall burden, but will result in the burden being transferred to existing collections. Once the entire burden for 3150-0203 has been transferred to the correct clearances, we will submit an 83-D to discontinue 3150-0203. A total burden of 39,684 hours will be transferred to existing clearances, resulting in a revised total burden of 0 hours for 3150-0203.
