SUPPORTING STATEMENT




1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


Sections 4980B, 4980D, 4980E, and 4980G provide for an excise tax for certain failures by employers, group health plans, HMOs, and third party administrators related to group health benefits. Form 8928 will be used to calculate and remit the amount of excise tax owed under these sections.


2. USE OF DATA


The Internal Revenue Service will process Form 8928 and the payments collected when the form is filed.

We have no plans at this time to offer electronic filing because of the low volume compared to the cost of electronic enabling.

We have attempted to eliminate duplication within the agency wherever possible.

Periodic meetings are held between IRS personnel and representatives of various professional groups to discuss tax law and tax forms. During these meetings, there is an opportunity for those attending to make comments regarding the collection requirements under this form.


We will publish a notice in the Federal Register in the near future to solicit public comments on this form.
