Section 307(b) of the Communications Act requires that the Commission effect a fair, efficient and equitable distribution of radio stations throughout the United States. In the context of competitive bidding application processing, Section 307(b) is relevant when a mutually exclusive AM application group consists of applications to serve different communities, or when a non-mutually exclusive AM application proposes a community of license change. Such applicants must submit supplemental information addressing Section 307(b) criteria. The data submitted will be used to determine the community having the greater need for an AM radio service. On April 7, 2009, the Commission adopted a Notice of Proposed Rule Making, In the Matter of Policies to Promote Rural Radio Service and to Streamline Allotment, and Assignment Policies, MB Docket No. 09-52, FCC 09-30. In this document, the Commission proposed a number of changes to its policies and procedures in comparing mutually exclusive applications pursuant to 47 U.S.C. § 307(b).

On April 7, 2009, the Commission adopted a Notice of Proposed Rule Making in the Matter of Policies to Promote Rural Radio Service and to Streamline Allotment, and Assignment Policies, MB Docket No. 09-52, FCC 09-30 (released Apr. 20, 2009). As a result of this action, we have program changes of +39 burden hours and +$4,550 cost burden for this information collection. There are adjustments of -785 burden hours and -$94,000 cost burden which are due to the Commission re-evaluating the number of respondents and responses for this information collection since these items were last approved by OMB.
