This exhibit includes the burden and cost reductions expected to result from the court’s decision to require NPDES permits only
from CAFOS that discharge or design, construct, operate, or maintain their facility such that a discharge will occur. This
reduction was calculated from a baseline of the information collection burden imposed under the 2003 CAFO rule, adjusted to
present conditions.
This exhibit does not calculate the additional costs that those CAFOs that do not have a duty to apply for an NPDES permit will
incur as part of qualifying for the agricultural stormwater exemption.
