The Nuclear Regulatory Commission
(NRC) amended its regulations to include jurisdiction over discrete
sources of radium-226, accelerator-produced radioactive materials,
and discrete sources of naturally occurring radioactive material,
as required by the Energy Policy Act of 2005 (EPAct), which was
signed into law on August 8, 2005. This provides a regulatory
framework by which to license and regulate byproduct material in
accordance with the new, expanded definition. The amended
regulations impacted numerous existing information collections. The
NRC packaged all of the impacted information collections into one
new information collection which OMB approved and assigned control
number 3150-0203. One of the areas of existing Nuclear Regulatory
Commission (NRC) regulations revised was Part 32.
During this period, a net
decrease in estimated burden hours of 12,684 (179,188 hours
166,504 hours) is expected. a. Exempt distribution license review
has been eliminated since the application review costs are already
reported under OMB Clearance No. 3150-0120 for NRC Form 313. b. The
total number of recordkeepers has decreased from 975 to 665 to more
accurately reflect current data in the License Tracking System and
Agreement State data. This contributed towards the decrease in
total burden hours. c. There is a reduction in the number of
respondents for Section 32.210 by 376 respondents from 600 to 224;
the number of responses by 752 from 1,200 to 448 responses; and the
burden by 15,792 hours from 25,200 to 9,408 hours. This reduction
is based on the current number of actions processed in the past 3
years rather than the total number of registrants, resulting in an
overall burden reduction for this section of an estimated 12,684
hours. The overall burden for this clearance has therefore
decreased by an estimated 12,684 hours from the currently approved
burden of 179,188 hours to the proposed burden of 166,504 hours.
When this package was submitted to OMB for approval in 2008, it was
entered so that it contained two separate IC's split into beginning
balances of 136,191 and 42,997 burden hours. To fix this, upon the
advice of OMB's contractor, an 83-C was prepared to remove the
42,997 hours and add them to the 136,191 hours for a total burden
hours of 179,188 hours. It corrected this package's beginning
balance of 179,188 hours in ROCIS.
