JUSTIFICATION FOR GRANTING OF 3 YEAR APPROVAL


USICE is requesting that OMB grant this Collection of Information an exemption from the GPEA requirements and thus a 3 year approval due to the special circumstances associated with the collection.

In the case of the ICE I-246 the agency does not employ, nor are there any plans to employ, the use of information technology to collect and process the information taken in this collection due to the nature of the benefit to which the respondents are applying. Respondents are required to present certain original documents in person as a part of this collection which can not be accepted electronically (passports, birth certificates, etc.) in order to eliminate manipulated or falsified copies being used to obtain the benefit illegally.


USICE is a federal law enforcement agency that on a daily basis interacts with individuals who may be in violation of Federal laws and subject to deportation. This particular collection of information is used to assist in the determination of allowing an individual to remain in the United States for reasons specified by the individual in spite of the fact that they have been ordered deported by an immigration judge.
