A. Background


Two Excel spreadsheets outline the information each State must provide the appropriate Regional Office of the Centers for Medicare & Medicaid Services (CMS) each calendar quarter, in accordance with the reporting requirements in two sections of the American Recovery and Reinvestment Act of 2009 (Recovery Act, P.L. 111-5), signed by President Obama on February 17, 2009:

  • 5001 Temporary Increase of Medicaid Federal Medical Assistance Percentage (FMAP)

  • 5004(d) Extension of Transitional Medical Assistance (TMA)


B. Justification


  1. Need and Legal Basis

The Secretary of Health and Human Services is required to submit annual reports to Congress with information collected from States in accordance with sections 5001 and 5004(d) of the Recovery Act.


  1. Information Users

All State Medicaid Agencies in 50 States will complete the reports. CMS will review the information to determine if each State has met all the reporting requirements of sections 5001 and 5004(d) of the Recovery Act.


  1. Improved Information Technology

The reporting forms are available in electronic format as Excel spreadsheets. We expect every submittal to be forwarded to our agency using the electronic format. The documents are completed in a user-friendly format.


  1. Duplication of Similar Information

There is no duplication of similar information.


  1. Small Businesses

This collection does not impact small businesses.


  1. Less Frequent Collection

The Recovery Act requires that each State provide reports every calendar quarter with the information specified for collection in sections 5001 and 5004(d) of the Recovery Act.


  1. Special Circumstances

There are no special circumstances or impediments. The two Excel spreadsheets are available in electronic format and will be provided to each State Medicaid Program by the appropriate CMS Regional Office.


  1. Federal Register Notice/Outside Consultation

An emergency 30-day Federal Register notice was published on 9/9/2009, attached. CMS has also shared a draft version of these spreadsheets with both the American Public Health Services Association and with States.


  1. Payment/Gift To Respondent

There is no payment/gift to respondents.


  1. Confidentiality

There is no personal identifying information collected in the document. All the information is available to the public.


  1. Sensitive Questions

There are no questions of a sensitive nature.


  1. Burden Estimate (Total Hours & Wages)

One Excel spreadsheet will be completed for section 5001 of the Recovery Act and another for section 5004. We estimate that it will take no longer than 3 hours (1 hour for section 5001 and 2 hours for section 5004) for a State to complete and submit the spreadsheets to CMS for each of the four quarters in each Federal fiscal year (FY). The required number of respondents is the 50 States. However, since the reporting requirements for section 5001 took effect on October 1, 2008 and for section 5004 on July 1, 2009, four quarterly reports are required for section 5001 and one quarterly report for section 5004 during Federal FY 2009. In subsequent years, four quarterly reports will be required for section 5001 and four for section 5004, until the authority for those sections of the Recovery Act sunsets. Therefore, the total burden would be 300 hours during Federal FY 2009 and 600 hours in each subsequent year.


To complete and submit the two quarterly spreadsheets, it would cost a State no more than $30 per hour. Therefore, the total cost is estimated as $9,000 for Federal FY 2009 and $18,000 for each subsequent year.

There are no capital costs.


  1. Cost to Federal Government

There is no additional cost to the Federal Government because existing staff resources will be used.


  1. Program or Burden Changes

This is a new collection.


  1. Publication and Tabulation Dates

Summary reports are required to be submitted to Congress each year after States’ quarterly reports have been received and compiled.


  1. Expiration Date

  • For section 5001: September 30, 2011

  • For section 5004(d): the sunset date for sections 1902(e)(1)(B) and 1925(f) of the Social Security Act (currently December 31, 2010)


  1. Certification Statement

There are no exceptions to the certification statement.


C. Collection of Information Employing Statistical Methods

The use of statistical methods does not apply to this form.
